Terms of Service
Effective date: May 20, 2026
These Terms govern access to and use of Sales Command, including the web app, dashboards, communications tools, automations, integrations, and related services.
1. Acceptance
By creating an account, accepting an invitation, accessing the app, or using Sales Command, you agree to these Terms and to the Privacy Policy. If you use Sales Command for a company, agency, team, or other organization, you represent that you are authorized to accept these Terms on its behalf.
2. The service
Sales Command is a sales workflow and communications platform for managing leads, calls, texts, emails, notes, follow-up tasks, appointments, team activity, recordings, transcripts, summaries, and related sales operations.
We may improve, modify, suspend, or discontinue features at any time. We do not guarantee that any feature will be uninterrupted, error-free, or available at all times.
3. Accounts and administrators
You are responsible for keeping login credentials secure, controlling who has access to your workspace, setting appropriate permissions, and all activity that occurs under your account or workspace. You must provide accurate account information and promptly update it when it changes.
4. Customer data
You retain ownership of the leads, contacts, messages, recordings, notes, files, and other content you submit to Sales Command. You grant us the limited right to host, process, transmit, display, analyze, and store that content as needed to provide, secure, support, and improve the service.
You are responsible for the accuracy, legality, permissions, and rights connected to the data you upload, import, sync, or send through Sales Command.
5. Communications compliance
Sales Command may help users call, text, email, route, record, summarize, and follow up with leads or customers. You are solely responsible for making sure your use of those tools complies with all laws, rules, industry standards, platform rules, carrier rules, and consent requirements that apply to your business and your contacts.
Without limiting that responsibility, you must obtain and document any required consent before sending calls, texts, emails, automated messages, marketing messages, recordings, or AI-assisted communications. You must honor opt-outs, unsubscribe requests, do-not-call requests, consent revocations, and suppression requirements promptly.
You may not use Sales Command to send spam, deceptive messages, unlawful telemarketing, unlawful robocalls, unlawful robotexts, misleading sender information, harassment, abusive content, or messages to people who have opted out.
6. Recordings, transcripts, and AI-assisted features
If you use call recording, voicemail, transcription, summaries, scoring, recommendations, or other AI-assisted features, you are responsible for notifying participants and obtaining consent where required. AI-generated outputs may be incomplete, inaccurate, delayed, or inappropriate for your specific situation. You must review outputs before relying on them or sending them to others.
7. Acceptable use
You agree not to:
- use Sales Command for illegal, deceptive, abusive, harmful, or unauthorized activity;
- attempt to bypass authentication, security, billing, rate limits, usage limits, or access controls;
- upload malware, malicious code, or content that infringes someone else's rights;
- collect, process, or transmit sensitive personal information unless you have all required rights and safeguards;
- interfere with the service, infrastructure, providers, carriers, or other users.
8. Third-party services
Sales Command may rely on third-party providers for hosting, authentication, billing, email, messaging, calling, storage, analytics, and AI functionality. Your use of those connected features may be subject to the third-party provider's own terms, limitations, and availability.
9. Fees and billing
Paid plans, usage-based charges, taxes, renewals, cancellations, and refunds are handled according to the pricing, checkout, subscription, or order terms shown when you purchase or activate paid service. You authorize us and our payment processor to charge the payment method provided for applicable fees.
Sales Command includes normal business use of calling, texting, AI summaries, transcription, reminders, and call recording. Accounts with unusually high call volume, text volume, transcription usage, AI processing, storage usage, or other heavy system usage may be subject to a usage review and may need to move to a high-volume plan, custom plan, or adjusted pricing to continue supporting that level of usage.
10. Security and availability
We use reasonable safeguards to protect the service, but no internet service is guaranteed to be perfectly secure, uninterrupted, or error-free. You are responsible for your own devices, networks, access controls, exports, backups, and user permissions.
11. Disclaimers
Sales Command is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, uninterrupted service, error-free operation, and legal or regulatory compliance for your specific business.
12. Limitation of liability
To the maximum extent permitted by law, Sales Command and its owners, operators, employees, contractors, providers, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, punitive, or lost-profit damages, or for loss of data, revenue, goodwill, business opportunity, or business interruption.
To the maximum extent permitted by law, our total liability for any claim related to Sales Command will not exceed the amount you paid for the service during the three months before the event giving rise to the claim, or CAD $100 if you have not paid for the service.
13. Indemnity
You agree to defend, indemnify, and hold Sales Command and its owners, operators, employees, contractors, providers, and affiliates harmless from claims, damages, fines, penalties, costs, and expenses arising from your data, your communications, your use of the service, your violation of these Terms, or your violation of law or third-party rights.
14. Suspension and termination
We may suspend or terminate access if we believe you violated these Terms, created security or legal risk, failed to pay fees, abused the service, harmed other users, or used the service in a way that could create liability for Sales Command or its providers.
15. Changes to these Terms
We may update these Terms from time to time. The updated version will be posted with a new effective date. Continued use of Sales Command after an update means you accept the updated Terms.
16. Governing law
Unless a different jurisdiction is required by applicable law, these Terms are governed by the laws of Ontario, Canada, without regard to conflict-of-law rules.
